End User License Agreement

Please read this agreement carefully before using our application.

1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Materic ("Company", "we", "us", or "our") governing your use of the Materic application ("App").

By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree to this EULA, do not download, install, or use the App.

2. License Grant

Subject to the terms of this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on devices you own or control.
  • Use the App for your personal, non-commercial purposes.
  • Access and use the features and functionality of the App.

3. Restrictions

You agree not to:

  • Copy, modify, or distribute the App or any portion thereof.
  • Reverse engineer, decompile, or disassemble the App.
  • Rent, lease, lend, sell, or sublicense the App.
  • Remove or alter any proprietary notices or labels on the App.
  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to circumvent any technical measures we use to protect the App.

4. Intellectual Property

The App and its original content, features, and functionality are owned by Materic and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

This EULA does not grant you any rights to our trademarks or service marks.

5. Apple App Store Terms

If you downloaded the App from the Apple App Store, additional terms apply:

  • This EULA is between you and Materic, not with Apple Inc. Apple is not responsible for the App.
  • Apple has no obligation to provide maintenance and support for the App.
  • In the event of any failure of the App to conform to applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App.
  • Apple and its subsidiaries are third-party beneficiaries of this EULA and have the right to enforce it against you.

6. User-Generated Content

If the App allows you to submit content, you retain ownership of your content. By submitting content, you grant us a worldwide, royalty-free license to use, reproduce, modify, and distribute that content in connection with operating the App.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into this EULA by reference.

8. Updates and Modifications

We may update the App and this EULA from time to time. We will notify you of significant changes. Continued use of the App after changes constitutes acceptance of the updated EULA.

9. Termination

This EULA is effective until terminated. Your rights automatically terminate if you breach any term of this EULA. Upon termination, you must cease all use of the App and delete all copies.

We may terminate this EULA at any time by providing notice to you, or by terminating your access to the App.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MATERIC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR YOUR USE OF THE APP.

12. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which Materic operates, without regard to its conflict of law provisions.
